In fact, although Louisiana has made some important criminal justice reforms since Montgomery — including raising the age at which juveniles can be automatically transferred to adult court — a 2017 amicus brief before the U.S. Supreme Court by the Louisiana Center for Children’s Rights and Juvenile Law Center argued that prosecutors continue to defy Miller and its progeny in their approach to old and new cases alike.
