Jonathan R. v. Morrisey

A federal district court sua sponte dismissed claims of due process violations in West Virginia’s administration of its foster system, brought on behalf of a class of children and was subsequently appealed to the United States Court of Appeal for the Fourth Circuit.

Juvenile Law Center joined an amicus brief filed by Quinn Emanuel Urguhart & Sullivan LLP on behalf of National Center for Youth Law and over 30 other amici in the Fourth Circuit, arguing that the district court’s order has far-reaching consequences that will deprive youth of systemwide remedies for violations of their constitutional rights and that institutional reform litigation is necessary to secure constitutional protections, particularly for historically marginalized groups,  and has delivered meaningful, long-lasting results.
