J.B. v. Ohio

Juvenile Law Center filed an amicus brief supporting a petition for a writ of certiorari in the United States Supreme Court arguing: (1) that age is relevant to the determination of whether a suspect is in custody and thus should receive Miranda warnings before being questioned and therefore that a 13-year-old questioned at his home by police about the death of his one-year-old brother was  entitled to Miranda warnings and (2) that Ohio law allowing a juvenile court judge to impose an adult sentence on the basis of judicial fact-finding violated the youth’s right to a jury trial under the Sixth Amendment.

The Supreme Court denied the petition for the writ of certiorari.
